Terms of Use

1. Definitions

• User: a natural person using the Service as a consumer.
• Business Account: a commercial user offering goods/services through the Service.
• Token: a non-cash, non-redeemable virtual unit used inside the app.
• Content: any text, image, comment, message, invite, event or campaign data shared through the Service.

2. Nature of the Service

Localuck is an intermediary digital platform that lets you discover local businesses, take part in events and loyalty campaigns and interact with other users and businesses. Localuck is not the seller or supplier of goods/services offered by businesses, and is not a party to any contract between a business and a user. Where applicable, Localuck acts as an intermediary service provider under Turkish e-commerce law (Law no. 6563).

3. Account & Eligibility

• You must be at least 13 years old to use the Service; if you are under 18, you may only use it with parental/guardian consent.
• You promise that the information you provide is accurate, current and complete.
• You are responsible for keeping your password confidential and for all activity on your account.
• If you open a Business Account, you represent that you are authorised to act for the business. Localuck may approve or reject business sign-ups.
• No fake identities, no duplicate accounts.

4. Acceptable Use

You must not, and must not allow anyone else to:

• Violate applicable law (including Turkish Laws no. 5651, 6698, 5237, 6502, 6563);
• Post content that is harassing, hateful, discriminatory, inciting violence, obscene, or that exploits children;
• Infringe anyone's intellectual property rights;
• Send spam, run bots / scrapers, create fake accounts, fake reviews, fake engagement;
• Tamper with the infrastructure, reverse engineer, or bypass security mechanisms;
• Collect or expose other users' personal data without their consent;
• Fake, copy or share QR codes or otherwise manipulate the loyalty / redemption system;
• (Business Accounts) make misleading offers, sell prohibited goods (alcohol/tobacco/gambling/illegal items), or violate consumer protection law.

Violations may lead to content removal, suspension or termination of your account.

5. User Content

You keep all intellectual property rights in the Content you upload. To let us run the Service you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce and show your Content to other users, solely for operating the Service. When you delete your account this licence ends, except for reasonable back-ups and for Content other users continue to share.

We are not obliged to pre-moderate Content but may remove anything we find in breach of these Terms. For notice-and-takedown requests, email info@localuck.com.

6. Tokens & In-App Purchases

• Tokens are non-cash, non-redeemable virtual units used to unlock features (e.g. paid pair-note messages, creating campaigns).
• Tokens are bought through Apple App Store / Google Play Store or other channels Localuck designates. Localuck does not access your card data.
• Tokens are tied to your account and may not be transferred or sold.
• Right of withdrawal: Under Turkish consumer law, because tokens are digital content whose delivery starts immediately with your express consent, the statutory right of withdrawal does not apply after purchase. Where you have unused tokens, you may request a refund at info@localuck.com; refunds are assessed in line with Apple/Google store policies.
• In case of fraud or abuse Localuck may revoke tokens and close the account.

7. Campaigns, Stamps & QR Use

• Loyalty cards, offers and flash campaigns are issued by the relevant Business. Terms, duration and usage limits are shown in the app.
• Redemption happens when a business staff member scans your short-lived rotating QR code. The QR refreshes automatically; taking a screenshot may invalidate the current token.
• The Business is solely responsible for the goods/services offered, their quality, defects and consumer rights. Bring complaints first to the Business; where unresolved, you may apply to Turkish Consumer Arbitration Committees under Law no. 6502.

8. Advertising & Third-Party Links

The Service may contain ads served via Google AdMob. Ads are subject to the third-party ad network's policies. Localuck is not responsible for third-party ad content or linked sites.

9. Intellectual Property

The Localuck name, logo, app design and software belong to Localuck or its licensors and are protected by intellectual property laws. You may not copy, distribute, reverse engineer or create derivative works without our prior written permission.

10. Disclaimer & Limitation of Liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Localuck is not liable for indirect, incidental, special or consequential damages or lost profits. Our total liability is capped at the amounts you have paid for the Service (if any) in the 12 months preceding the claim. This cap does not apply to gross negligence, wilful misconduct, or non-waivable consumer rights.

11. Suspension & Termination

We may suspend or terminate your account without prior notice for breach of these Terms or law, payment disputes, security incidents or suspected fraud. You may delete your account at any time from the app or by writing to info@localuck.com. Remaining token balances become unusable when the account is closed.

12. Changes

We may change these Terms from time to time. Material changes are announced in advance via in-app notice or email. Continued use after a change means you accept the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Users acting as consumers retain protection of mandatory consumer law and may bring claims before consumer arbitration committees and courts at their place of residence. Otherwise the courts and enforcement offices of Istanbul (Çağlayan) have exclusive jurisdiction.

14. Data Processing & Cross-Border Transfer / Storage

To provide the Service, your personal data may be transferred to and stored in countries outside Türkiye (notably the EU and the US) where cloud providers such as Firebase / Google and Apple operate their servers and data centres (e.g. europe-west1 / europe-west3). Such transfer and storage are carried out under appropriate safeguards providing adequate protection (e.g. Standard Contractual Clauses) in line with KVKK art. 9. Details of what data is processed, transferred and stored, and the applicable retention periods, are set out in the Privacy Policy. The optional explicit consent for showing group- and you-specific campaigns is governed by the Explicit Consent text; declining it does not affect the transfers necessary to provide the Service.
